yeah, what mike said!

an NDA is a bit of a class demarcation, like souris said (well,
or didn't, kinda). and who wants to spend their time chasing a
breached NDA, anyway? dirty lollipop syndrome!

FrieNDA. Friend + NDA. personal + legal. it's a double-trust
factor. but, really, in the real world, the friend part is far
more important, more valuable, more interesting, and more
enforceable. an NDA is just a patch-job for a reputation. i
think someone else kinda said that, too.

i've had dozens of m/NDAs signed in my day (at Construct, then
Headcase / E&S), and i never felt really good about it. i've
signed as many and none of them ever protected an idea i didn't
already know about. in the end they're a waste of time.

i like to think that a good idea is one that no one else on the
planet could implement.

Mike Kuniavsky wrote: I'm of the opinion that if someone I'm

they should put a ring on it and sign the NDA without blinking.
An NDA isn't a patent. It's just an agreement that says that the
signer won't reveal what you told them to a potential
competitor. That's it. You can put a time limit on it, say three
months. Anyone, in any industry, should be able to keep from
telling a competitor about your idea for THREE MONTHS. If they
can't, or can't guarantee that, then they're probably not
someone you should be talking to. Conversely, when someone says
"I can't tell you anything about my idea until you sign an NDA,"=
I call bullshit on that, too. You can tell me something. You can
tell me just about everything except for what your secret sauce
is, and that'll get me close enough to knowing whether I even
want to know what the secret sauce is. In either case, I say
absolutes kill trust. They kill trust when someone says that
they're not willing to meet you even an inch of the way (aka
sign a simple NDA) and they kill when someone says that they
can't trust you at all until they have an iron clad guarantee of
confidentiality (which an NDA isn't, so that's bullshit, too).
Finally, I have never heard of someone being sued for breach of
NDA. It's just not important enough in the larger scheme of
things. It IS important, however, as a small trust-building step
at the right point in a discussion. On Wed, 19 Jan 2011, Kim

We have our ideas taken all the time after an NDA is signed, usually at the request of the other party. It isn't worth pursuing. Bringing it up means that relationship is over. You may ask, well, if they took your
idea or part of it then why would you work with them again? To which I
respond- they like your ideas and will probably fund one in the future. This has been my experience at least.

I get asked to sign NDAs all the time before people consent to be
interviewed for my (totally academic, not gonna be published for
a year) dissertation. I see it as essentially an ass-covering
move.

On the one hand, I don't take them all that seriously. Because,
as Mike says, no one ever gets sued for breach of NDA.
Instead, the NDA for my interviewees is a way for mid-level
creatives to protect themselves against any kind of douchey
retaliation by their companies' legal departments. Or a way
for principals, partners, or C-level people to let me know
that they're personally okay with giving me sensitive
information about clients or vendors, but that it matters to
their companies. Because, really, there are two outcomes if I
violate the NDA: (1) no one will ever find out it was me,
because anything people are willing to tell me in a casual
interview is something that's already common knowledge among
tens, if not hundreds of other potentially indiscreet
blabbers or (2) I'll gain a reputation for being
untrustworthy and people will stop giving me sensitive info.

On the other hand, I take them very seriously. NDAs are just a
way to confirm that you, the signer, are outside an
organizational boundary, and that you are getting privileged
access to something that would usually stay within that
boundary. Verbal or paper-based requests have about the same
level of importance in terms of signalling one's
expectations. You could argue (and I would, when I'm being
all academic) that it is the NDA that makes the
organizational boundary, not the other way around. So it's
important for me to know that the person I'm talking to wants
to erect some boundaries.

But then, I'm not in the game industry. Or in marketing. Or in
entertainment. I do interactive product and service design and
strategy. As Mike suggests, different industries have really
different assumptions about the relationship between
organizations and information sharing. Some industries,
looking at the responses on this list, use NDAs (or "keep a
secret" language) to create stricter boundary lines than
others.

I saw this job posting at Berkeley, actually. Are you going to be
actively working with the intern? If you are, I will forward it
around even more widely to students (like at CCA) who do great UX
work but aren't, ummm, the traditional Qualcomm hires.

Assuming that you're all backed up, I wouldn't worry about it.
Occasionally, Macs will do the old bombshell crash. They usually recover.
Once you're back up and running, you might want to consider repairing
disk permissions (that's always a good thing to do, anyway). You do that by going into your Applications folder, then choosing Utilities, then
choosing Disk Utility, and then Repair permissions.

I think you'll be fine. Hopefully, you're properly backed up.

You had a Kernel Panic. It can be caused by hardware or by the System= , but rarely by an App.
Disk permissions resets are meaningless unless you are having an actual per= missions issue. Same with the voodoo 'Pram Zap'.
Either run -fsck n your drive in single user mode, or boot from your OS dis= c and run the actual disc repair, which looks at the file structure.
Unless it happens again you are probably fine.

(Sorry, Ex Applecare agent).

that's a kernel panic - i've been seeing that regularly working with = the adruino FTDI drivers in maxMSP. I wouldn't worry too much about it unl= ess you had some unsaved important documents open.

I think this is cause by some miscommunication between the USB port and the= other device. If it happens every time you try to update your GPS softwar= e - try switching the USB port you're using... but yeah, it sucks - and is = likely due to an iffy USB driver that Garmin is using (like the iffy FTDI d= rivers that arduino uses(used)).

Thanks SO MUCH, dudes.

D, I followed your instructions and everything looks OK. THANK YOU for spelling it all out, cause I'm a fucking numbnut these days and can't
find shit anywhere on this Apple computer (like find your so-and-so-
utility-so-and-so).

I have everything backed up on two external hard drives now (thanks
Julian, Neb, and DJ)! That said, I didn't lose any work.

THANKS, again.

As Wiley pointed out, the repair disk permissions thing almost certai= nly
didn't help with this particular situation. But it's always good to run that once in awhile anyway.

Glad things are looking better now.

=20 APPLE APPS and GOATS

Welcome to 2007, my friends!

DANIEL TERDIMAN has loaned me his spare 32GB iTouch and I want to
check out everything you guys have been raving about. EXCEPT THAT,
when I went to access the frieNDA files, there was NO SUCH file for
APPLE APPS, as many times as I know others have inquired about it.
Normally, I'd go through ALL MY FRIENDA EMAIL and search and find the
answers, but with the recent crash of the server I was hosted on, I
ended up losing thousands of my emails (I also deleted my apple
account not knowing it would wipe out my mail messages so this really
screwed up my back up / rebooting process). BLAH BLAH BLAH.

WHO, I said... WHO on this board has asked for the apps before? Can
you send me the suggested list and I'll add it to a master file in the MISCELLANEOUS folder.

Also, Wiley's DEFENSE OF THE IPAD is the sole entry to the GOAT
(greatest of all time frieNDA posts). Is it true that we only have ONE POST that qualifies for GOAT status?!

THANKS in advance!

Yes. DJ set it up. But there's gotta be MORE entries?! Or is it a HIGHLANDER deal?!

And I think the only thing Juster nominated himself for was more lube
for that eye socket thingamagiggy.

I just think there's nothing close yet. And I read most of the mails (not this NDA thread, though).

Christina was the person that asked for ONE APP RECOMMENDATION PER PE= RSON when he got his iPhone.

Here are the ones I use the most:

YELP - Yeah, you can type in "tamales" or "nail salon" = or "book store" or "coffee" and hit the "close to = my location" button...which will pull up a list and then allow you to = click a button which will bring up a map with directions to the business.= =C2=A0 I use this ALL the time.=C2=A0=C2=A0

SHAZAM - Listens to songs and tells you what they are.=C2=A0 You can only a= sk for 5 songs a month unless you pay to upgrade ($3.99 i think... I paid).= =C2=A0

NIKE+
GPS - You don't even need the Nike pod thingee for your shoes or the fancy= Nike shoes to use this app.=C2=A0 It tells you how fast you go, it maps yo= ur route and uploads your stats to Nike.com so that you can see how far you= 've run / power walked in a week/month/year.=C2=A0
THE BEST thing about it is that Tracy Jordan roots for me by saying "t= hat's my GURL!" and other fun things when I'm done.=C2=A0 You can also= sync with FB and when someone gives you a thumbs up or comments while you'= re running it CHEERS over your music.=C2=A0 Who likes to run?=C2=A0 Not me.= =C2=A0 Who likes to run when it's made fun?=C2=A0 I guess me.=C2=A0

WORDS WITH FRIENDS:
Scrabble with strangers or your friends... play at your leisure... you can = play like 15 game simultaneously too, I think.=C2=A0

INSTAGRAM:
It's like flickr with dumb hipstamatic type processing and you can "sh= are" a photo which posts it in a stream that everyone that's following= you can see.=C2=A0 A bunch of us are on it.=C2=A0 To quote Jason - "H= ey Instagram... CAT PHOTO, CAT PHOTO, CAT PHOTO.... How do YOU like it?&quo= t;=C2=A0 I keep looking for cats to photograph to share with Jason, but I d= on't ever see any....

FB
It's nice to just look at / post / and get notified of FB activity on a pho= ne app without having to log onto a computer.=C2=A0

KAYAK
Research travel on the go

INCEPTION:
Fun...creepy....fun and creepy.=C2=A0 You'll need headphones with a bu= ilt in microphone tho...

REDBOX:
I can reserve a $1 movie from my neighborhood kiosk (the 7-11 around the co= rner) and pick it up later before it runs out.=C2=A0 Popular titles run out= sometimes.=C2=A0 When you just don't want to wait for damned Netflix to co= me in the mail.=C2=A0

AIM:
You know when you IM me sometimes and I'm slow in responding?=C2=A0 I'm usi= ng the mobile version of IM and am texting with one finger.=C2=A0

MOONPHASE:
Cuz I like to know the phase of the moon...

FARECOMPARE
Also for travel.=C2=A0 Sends you alerts when a price drops or goes up on yo= ur watch list.=C2=A0 Self explanatory, really.

EBAY:
As if I don't have enough of a problem with Ebay...

TWEETDECK
Lets you follow your stream, has @replies in a sep column, DMs in another c= olumn and any lists you may follow in OTHER columns.=C2=A0 Good if you're s= earching for a certain keyword too (like #bedbugs )=C2=A0

TRIP ADVISOR
Mobile app - same as site

Welcome to 2007, my friends!
DANIEL TERDIMAN has loaned me his spare 32GB iTouch and I want to check out= everything you guys have been raving about. EXCEPT THAT, when I went to ac= cess the frieNDA files, there was NO SUCH file for APPLE APPS, as many time= s as I know others have inquired about it. Normally, I'd go through ALL MY = FRIENDA EMAIL and search and find the answers, but with the recent crash of= the server I was hosted on, I ended up losing thousands of my emails (I al= so deleted my apple account not knowing it would wipe out my mail messages = so this really screwed up my back up / rebooting process). BLAH BLAH BLAH.<= br> WHO, I said... WHO on this board has asked for the apps before? Can you sen= d me the suggested list and I'll add it to a master file in the MISCELLANEO= US folder.
Also, Wiley's DEFENSE OF THE IPAD is the sole entry to the GOAT (greatest o= f all time frieNDA
posts). Is it true that we only have ONE POST that qualifies for GOAT stat= us?!
THANKS in advance!

Reeder + Instapaper FT*MF*W! Though I use both 90% of the time on ipa= d. Still nice to have both on ipad & iPhone.

I like the Chase photo-check deposit app.

Shazam, pandora, snaptell, wikiamo, Netflix all get used a lot
